Barton Malow is currently hiring for the role of Claims/Litigation Counsel in our legal department based in Southfield, Michigan.  The ideal candidate will possess a solid understanding of construction law and experience in handling complex litigation matters.

 

Key Responsibilities:

  • Claims Management: Lead the identification, evaluation, and resolution of construction claims, including delay claims, scope changes, extra work claims, personal injury and construction and defect claims.
  • Litigation and Dispute Resolution: Assist outside Counsel and/or represent the organization in construction-related litigation, mediation, arbitration, and negotiations. Develop and execute legal strategies to resolve disputes efficiently while minimizing risk and potential damages as well as coordinate all phases of litigation from pre-trial preparation to trial and post-trial matters.
  • Contract Review and Drafting: Provide support in reviewing, drafting, and negotiating construction contracts, subcontracts, and change orders to ensure adequate risk management provisions.
  • Risk Assessment: Advise internal stakeholders on risk management strategies and compliance with construction laws and regulations to minimize exposure to disputes and claims throughout the project lifecycle.
  • Legal Research: Assist in performing legal research and drafting legal documents, including pleadings, motions, and discovery requests. Keep pulse on changes in construction law, case precedents, and industry trends impacting construction law and Barton Malow strategy.
  • Internal Collaboration: Collaborate and coordinate with internal subject matter experts, witnesses, project management teams, risk and legal teams, and other stakeholders to build compelling cases and gather relevant documentation.
  • External Collaboration: Oversee work product and claim strategy of outside attorneys representing Barton Malow. Coordinate with outside attorneys and insurance claims professionals to resolve claims and zealousy protect the organization's interest. 
  • Documentation Management: Oversee the preparation, organization, and analysis of project documentation, including correspondence, daily reports, schedules, and change order records, to support the company’s position in claims.
  • Claims Documentation: Regularly prepare claim summary and status updates within claims software system. 

 

Requirements:

  • Minimum five years of construction litigation/claims experience within a law firm or in-house counsel setting.
  • Must be skilled at communicating legal concepts and strategies to non-lawyers and synthesizing complex factual situation when providing advice.
  • Must be a collaborator with a positive attitude who enjoys a coordinated approach to delivering legal services.
  • Must be able to work effectively in a fast-paced environment.
  • Juris Doctor degree from an accredited law school.
  • Licensed and in good standing to practice law in one or more states.
